MM&I Energy - Affordable EPCs, Floor Plans & Energy Saving Advice

1. Introduction

1.1 This Energy Performance Certificate ("EPC"), floor plan or energy saving advice agreement ("the Agreement") is made between MM&I Energy, ("We") and the customer ("You”).
1.2 By entering into this agreement you are confirming you have read these Terms and Conditions and agree to them.
1.3 Once an order is placed (verbally or in writing) you agree to MM&I Energy producing an EPC, floor plan or energy saving advice for you ("the Order") and this agreement is legally binding.
1.4 This agreement is covered by the laws of England and Wales.

2. Your Responsibilities
2.1 You have the legal right to sell the property.
2.2 Information you supply is true and accurate and not misleading. MM&I Energy does not take any responsibility for the accuracy of the information supplied and cannot be held liable.
2.3 You will pay the fee quoted within 28 days of the invoice date or upon cancellation by yourself.
2.4 You agree to pay any extra costs incurred by MM&I Energy to produce the EPC, floor plan or energy saving advice before the completed EPC, floor plan or energy saving advice is released including but not limited to i. inability to gain entry to premises for EPC, floor plan or energy saving advice and/or home condition report: ii. customer supplying incorrect information.
2.5 You agree to ensure full access to the property for the energy assessor at the agreed date and time. Failure to provide access will result in an extra call out charge.
2.6 You will ensure you have the appropriate software to read PDF files e.g. Adobe Reader.
2.7 You will supply copies of your EPC, floor plan or energy saving advice to interested parties on request and store the master copy.
2.8 You will pay the costs of any printed copies of the EPC, floor plan or energy saving advice that are required by you or other interested parties.

3. MM&I Energy Responsibility
3.1 We reserve the right to reject or cancel an order at anytime.
3.2 The EPC will contain the compulsory documents as defined by the CLG.
3.3 We will contact you to arrange the EPC, floor plan or energy saving advice visit normally within 2 working days of placing the order.
3.4 We will supply the order by an electronic PDF normally within 1 to 2 working days after the energy assessment has taken place. However, please allow 28 days or longer in exceptional circumstances.
3.5 We will inform you by email when the order is complete with instructions how to download your EPC, floor plan or energy saving advice.
3.6 You may use the EPC, floor plan or energy saving advice supplied for any marketing of your property including private advertising or with an Estate Agent.
3.7 We will, to the best of our efforts, ensure that the MM&I Energy web site is available at all times. We reserve the right to take the site 'off-line' without prior notice for essential maintenance and upgrades.

4. Refunds
4.1 An EPC, floor plan or energy saving advice can be cancelled within 12hrs of ordering by email or phone subject to any costs incurred.
4.2 If we cancel your EPC, floor plan or energy saving advice we will refund your fee minus any costs incurred
4.3 The supply of EPC, floor plan or energy saving advice is excluded from the distance selling act as they are classed as “goods made to the consumer's specifications or clearly personalized”.
4.4 Under no circumstances will our liability exceed the value of the cost of supplying the EPC, floor plan or energy saving advice
4.5 We are not liable for an error in the EPC, floor plan or energy saving advice based on information including and not limited to from the public register, energy performance certificate, local searches, information provided by the seller, leaseholder or managing agents.
4.6 This does not affect your statutory rights as a consumer.
